Terms of Use
Last updated: 13 October 2026
These terms apply to the ShapeDay app for iPhone and Apple Watch and to the ShapeDay Pro subscription, provided by Aleksandr Melnik (“we”, “us”). By downloading or using ShapeDay you agree to them. They add to Apple's Licensed Application End User License Agreement (EULA), which also applies; if the two conflict, these terms apply to the extent the EULA allows.
1. Not medical advice
ShapeDay gives general nutrition and fitness information. It is not a medical device and does not diagnose, treat or prevent any disease or condition. Calorie, macro, nutrient, body-fat, recovery, fasting and timeline figures — especially AI estimates from photos, voice or text — are approximations and can be wrong; check anything important. Talk to a doctor or another qualified professional before changing your diet, fasting or training, particularly if you are pregnant or breastfeeding, have or had an eating disorder, have a medical condition or take medication. Stop and seek help if something feels wrong. Exercise animations and guides are simplified illustrations of common technique; they can't account for your body, injuries or equipment — learn new lifts with light weights and, where you can, a qualified coach. The pregnancy guide is for information only and does not replace your midwife or doctor. You must be at least 16 to use ShapeDay.
2. ShapeDay Pro subscription
- What it is. ShapeDay Pro is an auto-renewable subscription that unlocks the Pro features described in the app, billed monthly (ShapeDay Pro Monthly) or yearly (ShapeDay Pro Yearly).
- Price. In the United States: $4.99 a month or $34.99 a year. The price in your country and currency, including applicable taxes, is shown in the app and the App Store before you buy.
- Payment. Payment is charged to your Apple ID account at confirmation of purchase. If a free trial is offered, it is for new subscribers only and payment is charged when the trial ends; any unused part of a trial is forfeited when you buy a subscription.
- Automatic renewal. The subscription renews automatically for the same period and price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the period ends.
- Manage and cancel. Manage or cancel at any time in Settings → your name → Subscriptions on your iPhone (or in the App Store app). Cancelling stops the next renewal; Pro stays active until the end of the period you already paid for. Deleting the app does not cancel a subscription.
- Price changes. If the price changes, Apple tells you in advance and, where required, asks for your consent before charging the new price.
- Refunds. Payments are processed by Apple, so refunds are handled by Apple under its policies — request one at reportaproblem.apple.com. This does not affect any right to a refund or withdrawal you have under the law where you live.
- Restore. On a new or reset device, use “Restore purchases” in the app with the same Apple ID.
3. AI features and fair use
The free version includes a monthly allowance of AI requests; Pro removes that allowance, subject to a fair-use limit that exists only to stop abuse. AI answers are generated automatically and may be inaccurate or incomplete — review them before relying on them. Don't use ShapeDay to send content that is unlawful, that you don't have the right to share, or that contains other people's personal data without their permission.
4. Your content
What you log, the photos you take and the links you save stay yours. You allow us and our service providers to process the content you send to AI features only to provide those features to you, as described in the Privacy Policy.
5. Acceptable use
Don't misuse the service: no automated or bulk access to our servers, no reverse engineering except where the law allows it, no attempts to get around usage limits or subscriptions, and no interfering with the app, its servers or other people's use of them. We may limit or suspend access to AI features if they are being misused.
6. Our rights and third-party services
The app, its design, text, illustrations and code belong to us or our licensors; the EULA gives you a personal, non-transferable licence to use it. Some features rely on third-party services and data (for example Apple Health, Anthropic, Open Food Facts, USDA FoodData Central and Wikipedia); their own terms apply to them, and the Legal notice lists the data sources and licences.
7. Availability and changes
We work to keep ShapeDay running but can't promise it will always be available or error-free, and features may change. If we change these terms, we update the date above and, for significant changes, tell you in the app before they apply. If you don't agree with a change, you can stop using ShapeDay and cancel Pro; continuing to use it after a change takes effect means you accept the new terms.
8. Liability
ShapeDay is provided “as is” and “as available”. To the extent the law allows, we are not liable for indirect or consequential losses, or for decisions you make based on estimates in the app, and our total liability is limited to what you paid for ShapeDay Pro in the 12 months before the claim. Nothing in these terms excludes liability that cannot be excluded by law (such as for intent or gross negligence) or limits rights you have under mandatory consumer law where you live.
9. General
If part of these terms is found invalid, the rest still applies. Apple is not a party to these terms, except as a third-party beneficiary of the EULA as it describes. Questions or complaints: [email protected] — we try to answer within two business days.
